As part of technological developments in the global capital markets, and in light of the competition in the labor markets, many employers are diversifying the means of compensation awarded to their employees, by way of allocating options that can be converted into company shares or shares of a related company. In this way, the company gets to strengthen the employees' attachment to the company, and the employees get to benefit from the company's economic growth, which results, among other things, from the fruits of their labor. This article will present a brief overview of the tax consequences of allocating options to employees, including the tax consequences of allocating illegal options, and the difficulties inherent in the mechanisms that exist in tax law today. We then present our recommendation to update the current regulatory tax framework in light of the recent economic and technological changes that impact the labor market.
