תקציר בעברית:בפסק-הדין הנודע בעניין אדרס פסק בית-המשפט העליון שהנפגע מהפרת חוזה זכאי ליטול את רווחי המפר מההפרה בהתבסס על דיני עשיית עושר ולא במשפט. למרות העניין הרב שפסק-הדין עורר בישראל ומחוצה לה, המאמר טוען שלמעשה אין בתי-המשפט נוהגים להעניק סעד זה. המאמר מסביר מצב זה—כמו גם את שוליותן של תרופות שמטרתן ליטול את רווחי המפר בשיטות משפט אחרות—בהתבסס על התופעה הפסיכולוגית של שנאת הפסד. המאמר מציע שתופעה זו השפיעה ומשפיעה על האבולוציה של המשפט ועולה בקנה אחד עם התפיסות המוסריות הדאונטולוגיות העומדות בבסיסו. המאמר אף טוען ששנאת הפסד יכולה להצדיק את שוליותן של התרופות המיועדות ליטול את רווחי המפר. English Abstract:In the seminal Adras case, the Israeli Supreme Court ruled that a breach of contract entitles the injured party to disgorgement remedy based on the law of unjust enrichment. Despite the great interest this judgment has aroused in Israel and beyond, the Article demonstrates that in fact Israeli courts do not award this remedy. The Article explains this practice -- as well as the marginality of remedies aimed at protecting the disgorgement interest in other legal systems -- based on the psychological phenomenon of loss aversion. It suggests that loss aversion have influenced the evolution of the law and that it falls into line with deontological moral convictions underlying the law. The Article further argues that loss aversion provides a possible justification for the marginality of disgorgement remedies in contract law.
