The State Budget and the Principles of Taxation: Synergetic Effects and Judicial Review
Yoseph M. Edrey

Abstract: (the Hebrew abstract follows afterwards below).
Courts are reluctant to review governments policies. The article suggests ways to increase substantive judicial review of fiscal legislation. It offers a general-universal model and use the Israeli budget law of 2023-2024 as a case study.
In order to substantiate the model, the author discuses at the outset the different approaches regarding the constitutional judicial review of laws and Basic Laws in Israel, a brief criticism of the Bank HaMizrachi v. Migdal case, and his original and uncommon approach regarding the Knesset's limited authority for Basic legislation.
According to the author’s approach, the constitution has two objectives. One "the first crown" - determining the state’s characteristics, essence, principles, goals, and the recognized human rights. The "Second Crown" - Building the State's Institutions. The Israeli Constitutional Assembly, duly elected in 1949, was not authorized to transfer to the Knesset the power to deal with the First Crown. Its refusal to establish the Constitution created a lacuna, which is filled by the Declaration of Independence that details the main elements of the state of Israel and its human rights, i.e. the first crown. Those elements are beyond the reach of the Knesset. The Knesset is authorized only to legislate those Basic Laws which refer to the state institutions – i.e. the second crown.
Examining the Basic Law: The State's Economy shows that it deals with the two crowns. Under its first crown some constitutional principles may be identified: The requirement to levy taxes only by primary legislation or according to it, expresses, inter alia, the recognition of constitutional property rights and the idea that tax are levied and should paid by the public’s consent; The constitutional obligation to legislate a state budget every year, expresses the public's right to know, to monitor and supervise the administrative branch, and to be involved/engaged in the democratic process. The origin of these requirements is within the first crown, in the fact that the state is democratic. Hence the Basic law: the State Economy only declares their existence. The Knesset's authority to change them is extremely limited. On the other hand, the Knesset has the power to set the state institutions such as the State Comptroller, the authority to manage the state's assets and mint coins and banknotes.
The article consistently and analytically develops its main thesis showing avenues for judicial review of fiscal legislation. At its core is a simple claim. The tax has to provides a consideration to the payors - their benefit from the public goods and services the government provides ("PGS”).
Next, it indicates the direct relation between tax laws and budget legislation. In a democracy, without the provision of "PGS” there is no need for tax. Without tax it is not possible to provide PGS. The PGS constitute the consideration for the tax, the benefit it provides to the payors. The PGS’s cost is expressed in the government budget. Hence, the budget is a reliable and quite accurate estimate of the benefit the PGS provide.
From here the author continues and uses some insights from the field of public finance - such as "optimal tax" and “excess tax burden”/”dead weight loss” - for measuring the total cost of the tax, which is equal to the tax amounts plus the associated economic taxpayer’s costs such as the loss of well-being caused by the change in the taxpayer's preferences and priorities, in addition to related expenses for managing the taxpayers’ tax system and tax planning. Next he presents the following formula: Tax is levied trough primary legislation, which represents the taxpayers consent, in exchange for the PGS that the government provides. The consent is conditional on two main provisos. One, the tax must follow the four canons of “good tax”, of which one of them requires that the tax must be efficient. Second, - and one may argue it stems from the first condition – the benefit the taxpayers enjoy is greater/not less than the total cost of the tax they pay. When these conditions are not met, the consent to pay's assumption is eroded. Consequently the constitutionality presumption of the tax is in doubt and instead of a tax, the mandatory payment levied by the government becomes a confiscatory means that violates constitutional rights.
The legal problem of this formula stems from the practical difficulties in estimating its components: the total cost of the tax; and the value of the benefit that taxpayers enjoy in return.
The proposed solution is aided by two phenomena. One, originated in the world of exact sciences: “Synergistic Effects” which are the effects that arises between two or more agents, entities, factors, or substances that can produce an effect greater than the sum of their individual effects(1+2>3). The second, relates to the case study that is used to apply the suggested model. i.e. the irresponsible and unconditional budgets and money allocations the Israeli government offers to non-productive sectors.
The relationship between budget laws and tax legislation makes it possible to examine the constitutionality of fiscal legislation through the synergistic effects of these laws. That is to say, the benefit from the tax is the consideration that the taxpayers receive from the government PGS. The PGS’s benefit’s value is estimated by the PGS’s market price (their cost expressed in the budget law + a reasonabl rate profit/return).
As mentioned, one way to measure whether the tax is efficient is to examine whether the consideration it provides is high or at least equal to the total burden it imposes on the taxpayers. If it turns out that items in the budget not only do not contribute to the aggregate well-being but reduce it, then the requirement of the efficiency of the tax, which finances the budget, is not met, the tax does not follow the efficiency requirement and the presumptions of consent and the tax constitutionality no longer prevail.
The author uses a broad utilitarian approach for measuring the budget’s allocations and
their contribution to the general well-being.
Based on the common definition of Public Goods and Services - i.e non-excludable, and non-depletable or "non-rivalrous" - the proposed test for locating and classifying those allocations that reduce the general well-being is twofold: allocations intended only for a specific sector instead of the general public, and that they have a negative effect on the general well-being.
While using the case study, the article cites an overwhelmed number of professional opinions, memos, and letters written by leading and prominent economists, including academicians and public servants, which indicate a consensus that certain allocations in the state budget for the years 2023-2024 will create an immediate and long-term economic disaster to the state economy. They will increase poverty and social gaps, reduce the per person productivity and distort of the labour market. As a result, the national economy and sustainable economic growth will ill suffer.
The emerged conclusion from applying the the synergetic effects is that the devastating result of the 2023-2024 budget law undermines the tax efficiency, thus erodes the presumption of their constitutionality.
Since the option of the tax revolt - hidden or direct - is not discussed in the article, we are left with the following two possible remedies that could prevent the constitutional violation. One, to study the complicated tax system consisting of several tax laws, identify the elements that cause the erosion of the consent to pay assumption, and remove them from those laws. The second - to focus on the budget legislation and eradicate the destructive elements found in the budget law.
Practical reasons lead to the conclusion that the preferred remedy is the latter.

Abstract - Hebrew:

.LL.B; LL.M;.
