What is Israeli law’s position on sex segregation in public spaces? This article reviews the law on this question, contextualizing and anchoring it in the principles of Israel’s legal system. Alongside the constitutional and legislative norms from both public and private law, the article analyzes the two High Court of Justice cases that have delved into the legality of sex segregation – the Kiryat Arba segregated swimming pool hours case, and the case of sex segregation in academic programs. Part I sets the conceptual foundations for understanding the question at hand. It offers a triangular distinction between cases in which women are entirely banned from participation, cases in which segregation between men and women is asymmetrical and provides inferior conditions to women, and cases in which segregation is symmetrical. Israeli legislation and case law have recognized that all three types of cases infringe the right to equality. However, courts were willing to recognize the harm to equality more quickly and readily in the first two types of cases and, accordingly, to provide more potent remedies. Additionally, this distinction equips us with a new and significant tool for every normative assessment of sex segregation. Because many cases of exclusion or asymmetrical segregation are erroneously examined as “infringing the right to equality,” if they concern symmetrical sex segregation, every normative analysis must begin by asking whether the case indeed factually involves symmetrical segregation. Part I addresses additional preliminary questions, such as why theories of multiculturalism are irrelevant in the context of sex segregation in Israel’s public spaces, and the difference between segregation on buses or in academic studies and segregation in public bathrooms and locker-rooms. This analytical framework facilitates the review of the case law on sex segregation. Part II discusses the reasons for Israeli law’s suspicion of sex segregation and considers the substantive conditions and procedural hurdles Israeli law presents to rendering such segregation legal. Part III details the various ways in which sex segregation harms both members of religious communities that practice segregation and individuals outside of these communities. Part IV examines the differences between male-only and women-only spaces. Part V considers the normative status of efficiency considerations, often invoked in discussions about the legality of sex segregation. The article concludes with open questions that will likely engage public debates, lawmakers, and adjudicators in Israel in the foreseeable future.
