The Scope of Protection of Trademark Image

On the 30th of March, 2004, the Supreme Court of Israel gave its decision in McDonald’s v. Ariel McDonald. This decision raises interesting questions concerning the scope of protection of a trademark image. This article will examine the consequences of the decision in the light of the rationales of Intellectual Property law in general and Trademark law in particular.
