English Abstract:“Judicial Notice” is an exceptional doctrine of the law of evidence. It empowers the court to accept notorious facts that are generally accepted as matters of common knowledge without the need to be proven. Litigants are relieved of the duty to prove them as it would be both wasteful and pointless to require evidence. Two contradicting principles are in the core of that practice: a) legal efficiency, and b) principles of natural justice to expose legal decisions to review and criticism. In order to balance these principles, the notion of certain kind of facts as “Judicial Notice” has been developed.Supreme Court rulings have expanded the meaning of “Judicial Notice” also to facts which are not of common knowledge, but of the knowledge of experts and public appointees sitting on the bench with judges in other legal instances of which the most unique are the Labour Tribunals. That expansion has brought about recognition of facts as “Judicial Notice” in one kind of judiciary while not always in others even when they deal with the same Materia.Throughout the years judges in Israel have made use of parallel or additional terms and do not always differ between “Judicial Notice” and “Judicial Knowledge”. The use of the various terms has led to contradicting results, misunderstandings, and even to misleading. This phenomenon is noticed mainly in tribunals which include public appointees. Labour Tribunals are the main example. In this article we try to clarify the issue, to locate and analyse the problems raised throughout the years and propose a way for their regulation, with special linkage to labour courts, as well as drafting a new definition of “Judicial Notice” which takes into consideration the development approved by the judiciary. English Abstract:“Judicial Notice” is an exceptional doctrine of the law of evidence.
