English Abstract:Alongside the prosperity of the Peer to Peer Economy, many regulatory and legal issues arise. The "ugly truth" is that behind the seemingly prosperous success of the Peer to Peer Economy, workers are being exploited. The success of the Peer to Peer Economy comes at their expense and comes out of their pockets. The focal point of this paper is to examine how the Peer to Peer Economy affects the "employee" as defined by the Israeli labor law. As well as, proposing the proper definition and classification of the service providers (hereinafter: "Gig Workers") in this special working relationship. The existing dichotomies in Israeli labor law are no longer appropriate. It seems to be conceivable to create an alternative model, which is largely based upon the British legislature and the Israeli (and American) rulings. Therefore, it is conceivable to create an intermediate category ("Gig Worker"), thereby expanding the protections and rights granted under the protective legislation which will apply on the Gig Worker, as well. However, the paper discusses the difficulty of this proposal and suggests granting the Labor Court the ability to grant rights and protections to those workers who are not entitled according to the rigid definitions of the law. The granting of judicial rights can be done according to the standings and rulings of contemporary Israeli courts, by the doctrine of purposeful group interpretation, as suggested by Prof. Guy Davidov. By this approach, I believe that the Israeli labor law can provide a broader, more appropriate solution and maximize its purposes regarding special employment patterns, which nowadays, as seen on the Uber cases, remain disadvantaged. In other words, in any case, the Israeli legal status requires reconsideration in view of the developments in employment patterns. English Abstract:Alongside the prosperity of the Peer to Peer Economy, many regulatory and legal issues arise.
