The Lansky Case

The Supreme Court has recently been confronted with quite a number of major constitutional issues.' The present one undeniably ranks among those every student of Israeli public law will have to study for years to come. The principle involved was the fundamental right of every Jew to come and settle in Israel by virtue of the Law of Return. The importance of this statute results in special care being paid to the proper construction of its provisions. The first question that aroused controversy was, "Who is a Jew?" and again, consequent to the Shalit case, in 1970. The relevant provisions are immigrate to Israel. Another problem was that of deciding in which cases even a Jew may be denied the right of return: this was the point in issue in the Lansky case.
