Secondary Usage of Legal Information for Justice

בהליכים משפטיים רבים נאסף מידע מגוון על אודות הגורמים לעוולות ותאונות והתנאים אשר מאפשרים אותן. על פי רוב מטרת איסוף המידע איננה מניעת הישנותן של העוולות או תיקון התנאים המאפשרים אותן, כי אם השגת מטרה ממוקדת יותר, בהתאם להליך שבו מדובר – גיבוש מידת אשמתו של נאשם, אחריות נתבע אזרחי או מנהלי, שיקולי ענישה או הוצאה ממשמורת. מידע רב זה, שנאסף במימון ציבורי ניכר, אינו מנוצל בדרך כלל מעבר למטרתו המקורית והוא "נזרק" אחרי השימוש בו למטרתו המקורית. <br>מידע משפטי זה נאסף, מקוטלג ומאופיין על ידי בעלות ובעלי מקצוע, שמוסיפות ומוסיפים הערכה של קשרים סיבתיים אפשריים ומשקלים לגורמים השונים. מרכיבי מידע אלו באים לידי ביטוי באמצעות שימוש בקטגוריות ומושגים, הפניות לסעיפי חוק, סימון ברשימות וטפסים, ועל ידי הכנסת הנתונים לטבלאות ולמבני ידע, שפה וצורה קבועים וחוזרים.<br>לאור זאת אנו מציעים במחקר זה לאסוף את העובדות הפזורות בתיקים, מסמכים ותהליכים משפטיים השונים, לסדר ולאגם אותו, ואז לנתחו לצרכי הגברת צדק באופנים שונים. ביצוע פעולות מורכבות אלה בזול וביעילות נתמכת ביכולת חישובית לעיבוד נתונים (data analysis), כולל של נתוני עתק, ויכולת ההולכת ומתפתחת של ניתוח מידע של טקסטים בשפה חופשית (NLP), בעזרת אינטליגנציה מלאכותית ולמידת מכונה. פעולות אלה תעשינה עבור בעלות ובעלי תפקידים על ידי מדעניות נתונים ועל ידי גורמים מקצועיים כגון קרימינולוגים וסוציולוגים. ניתוח זה של המידע יכול לשרת מקבלות החלטות, פקידים ובעלי תפקידים ביצועיים ברמות השונות מאזנים בין היתר לצרכי אחריותיות, היזון חוזר, ביקורת עצמית, למידה, תכנון וקבלת החלטות. <br>ההצעה הכללית מחייבת שינויים חקיקתיים ומערכתיים. בחיבור זה נציע להתחיל במיצוי מידע מהליכים משפטיים, לשם מניעת אי-צדק עתידי ולשם הגדלת האחריותיות של הרשות המבצעת לעוולות. הצעה זו מצריכה גיבוש נהלים המאזנים בין היתרונות לחסרונות שיוצגו, אבל ניתן ליישמה כבר כעת.<br><br>Many legal processes include the gathering and analysis of varied information about causes for injustices, accidents and disputes, and about the conditions that enable these phenomena. The information is usualy not gathered in order to prevent future injustices of fixing the enabling conditions. it is used for limited, process specific goals like deciding a defendent's guilt, asigning responsibility, deciding on punishment or assigning custody. After thee goals are met, the information is ussualy "thrown away", and not used for other goals.<br><br>Legal information is ussually of high quality. it is gathered by proffesionals, who categorise, conceptualize, and add information about possible causal connections and assign wheight to various causes. they do so by ordering the data, refering to statues (and specific legal concepts and criterea), they quantify, document, and use forms of organized data (tables, numbers, datasets, repteating lingual formats, etc. Society invests a lot in this process.<br><br>Therefore we suggest that legal information should be available for secondary use to advance justice. we suggest to actively gather the data using up-to-date technologies, invest in identifying repeated patterns, encourage reporting to relevant parties and designated data-analysis officers.<br><br>this information will serve to enhance accountability, prevent injustice and inform planning and decisions by enabling self-critique, learning processes, feedback systems. <br><br>full secondary usage of data requires legislation and systemic changes. this preliminary article presents the argument for these processes, discusses the pro and cons, emphasyzing concerns and dangers, together with the moral imperetives to go forward. it also suggests immediate ways to begin responsible secondary use of data to promote justice.
