תקציר

The current research suggests the legal equalization of the mentally retarded Person to the infant and the applicability of the general defense of infancy upon mentally retarded persons. First, the research explores the unique characters of the mentally retarded population in comparison to infants and mentally ill persons. Later, the research explores the origins, rational and current utility of the general defense of infancy. Finally, the research suggests the legal applicability of the general defense of infancy in criminal law upon mentally retarded offenders. Such applicability influences not only the substantive law, but the relevant criminal procedure as to the indictment of mentally retarded persons.
