English Abstract: State regulation of public and commercial media is a common practice of modern democratic states. Since governmental regulation of the media raises various tensions with the constitutional right to free speech, this article examines the ideal 'division of labor' between the state branches, to ensure the unique public interest in the media.

In this paper, we focus on the Israeli example, in which the legislator acts de facto as the regulator of public and commercial media. In the first part, we identify the unusual properties of media regulation in Israel, in which much of the regulatory duties are designed by the legislator, rather than by the dedicated administrative, regulatory agencies of communication and media. In the second part, we analyze the practical and constitutional problems of this unique phenomenon. On the third part, we argue that although the legislator should determine the general purposes, structure and corporate governance of media regulation, free speech principles require the legislator to delegate powers and discretion to a dedicated independent. On the last part, we demonstrate how the limits and limitations of the legislator as the regulator of commercial media are relevant also to fields of public broadcast, by analyzing the newest media legislation in Israel – the Israeli Public Broadcast Act of 2014, which created a new statutory agency for public broadcast in Israel.
