Meital Pinto

Anti-discrimination doctrines in Israel associate discrimination with irrelevant distinctions, but it does not equate non-discrimination with irrelevancy. Irrelevant distinction are prohibited by law only when they are based on ‘suspicious’ grounds, such as nationality or sex, which flag individuals as belonging to a vulnerable socio-political group.
This paper, by contrast, argues that irrational distinctions, on their own, constitute discrimination, even when they have nothing to do with suspicious grounds. The paper explores the concept of irrelevancy in terms of arbitrariness or irrationality. It argues that arbitrary discrimination are discriminatory because they disregard the value of autonomy. In contrast to distinctions that infringe upon an individual’s autonomy, such as distinctions dependent on reliable proxies, arbitrary and irrational distinctions do not respect autonomy at all. This is because they utterly disregards the value of autonomy by not paying any attention to an individual’s relevant capacities and needs.
Because they disregard the value of autonomy, the paper suggests that Israeli law should acknowledge them as discriminatory in the contexts of anti-discrimination laws in the private sphere and in the labor market. Arbitrary distinctions, so the paper argues, should also be acknowledged as discriminations that infringe the constitutional right to equality.
However, although arbitrariness should be sufficient to the establishing of discrimination, it does not constitute the worst kind of discrimination. Distinctions based on irrelevant or relevant traits such as nationality and gender are the worst kind of discrimination because they demean individuals or groups associated with them by replicating familiar forms of discrimination that reproduced and preserved the vulnerability of those groups in the past.
