<p dir-"rtl"><b>תקציר בעברית: </b>מאמר זה עוסק ביחס שבין שיטת הפרשנות הדומיננטית במשפט הישראלי - שיטת הפרשנות התכליתית, ובין צורת הניתוח הכלכלית-פוליטית-משפטית הידועה בשם Public choice הבחירה הציבורית. שתי טענות מרכזיות מובאות במאמר זה. הטענה הראשונה היא כי גישת הבחירה הציבורית יכולה להצדיק אימוץ של שיטת מסוימת של פרשנות תכליתית על ידי בתי המשפט. בתי המשפט יכולים לתקן כמה מליקויי פעולות החקיקה והמינהל אם יפנימו את הביקורת של גישת הבחירה הציבורית, וישתמשו בכלי הפרשנות על מנת לתקן אותם. הטענה השניה המופיעה במאמר זה היא כי בתי המשפט בישראל לא הלכו בדרך זו, למרות שהיו להם ההזדמנויות לעשות כן. בתי המשפט נוטים להתעלם מהתובנות של גישת הבחירה הציבורית.</p><p dir-"rtl">המאמר מדגים את הטענות האמורות תוך התייחסות למוסד אחד – מכון התקנים הישראלי. המאמר מנתח שורה של פסיקות שעסקו בהחלטות מוסד זה, ומראה כיצד בית המשפט יכול היה להשתמש ברעיונות מתחום הבחירה הציבורית בפסיקותיו, ובחר, ברוב המקרים, שלא לעשות כן. בסופו של דבר מציע המאמר כמה דרכים בהם יוכל בית המשפט לאמץ כמה נקודות מבט של גישת הבחירה הציבורית.</p><p dir-"ltr"><b>English Abstract: </b> This article aims to explore the relationship between the dominant statutory interpretation method in Israeli jurisprudence – namely purposive statutory interpretation, and Public Choice Theory. This article makes two connected claims in this regard. The first is that Public Choice theory justifies the use of purposive statutory interpretation by court. Court can adopt a specific branch of purposive interpretation which would enable them to correct some of the fallacies of legislative and administrative process which the Public Choice theory highlights. The second claim made in this article is that courts in Israel have not chosen this path. In spite of numerous opportunities, the courts chose to overlook Public Choice, and ignore its implications.</p><p dir-"ltr">The article demonstrates this claim by focusing on one administrative agency – the Israeli Standards Institution. It suggests that in a series of court cases reviewing the decision of this agency, the court should have used public choice as a guiding tool. In most of the cases it chose not to do so.</p> <p dir-"ltr">At the end of the article I suggest several ways in which Israeli court could incorporate public choice into their jurisprudence.</p>
