Ron Kleinman
הנספח למאמר עוסק במכירה של "מפטיר יונה" עבור האדמו"ר מדינגא, חצר חסידית שאינה מוכרת, אשר פורסמה במשך כמה שנים לקראת יום כיפור באתר המכירות הנודע eBay.English Abstract:This article deals with the question of what is the halakhic-legal basis for selling aliyot and honors (kibbudim) in the Synagogue, which is called “selling mitzvot”.According to halakha, buying property requires a physical act, (Ma'aseh Kinyan, a mode of acquisition) and one cannot buy by speech only. It is also impossible to buy future goods (davar shelo ba la'olam) or intangible goods. Nevertheless, halakhic decisors (poskim) have given halakhic-legal validity for selling mitzvot. The various explanations of the halakhic decisors regarding the validity of selling mitzvot can be divided into three groups: (a). Property - There is a proprietary validity for the selling. (b). Obligation - this is an ordinary obligation or obligation that is equal to a vow and a sanctification (hekdesh). (c). Another legal basis: hiring workers or delegation. According to the sources examined in this article, most of the decisors held that selling mitzvot is a proprietary transaction, based on “local custom” (minhag ha-medinah) and on kinyan situmta, but many saw it as a vow and a sanctification. From the explanations given by the decisors to the validity of selling mitzvot, they concluded their decisions on halakhic questions brought before them, such as whether and until when, the parties to selling of mitzvot, the public and the purchaser, can retract the deal; and whether the purchaser of a mitzvah can decide to give the money to another synagogue. The appendix to the article deals with the sale of Mafatir Yonah for the Admor (Rebbe) of Dhengah, an unknown Hassidic court. For several years, the sale was advertised before Yom Kippur on the well-known eBay sales site.
