The past twenty years marked an increasing awareness in the harms of imprisonment and the benefits of parole for encouraging reintegration, countering reoffending and coping with prison overcrowding. In Israel, this awareness is expressed in recent years through efforts to promote effective penal policy that will decrease incarceration rates and increase the use of alternatives to imprisonment. Meanwhile, parole rates are in decline and most parole applications get rejected. Israel’s parole model is narrow to begin with, as it offers no option for automatic conditional release and requires every applicant to undergo a parole proceeding which balances between the prisoner’s prospects of rehabilitation and public protection. This article seeks to track the main factors for the limited use of parole in Israel by analysing decisions made by the parole committees at HaSharon Prison compound between 2017 to 2018. For the first time, this article provides an overview of the parole process in Israel, which includes an analysis of prisoners’ backgrounds, the outcomes of their applications and how parole committees reason their decisions. We focus on four central findings. First, in over a third of the cases, prisoners waived their right to apply for parole. Profile classification, e.g. ‘domestic abuse’ or ‘sex offender’ profile and, a conviction in a security or violent offence, were significant indicators for parole application waives. Second, the state objected to parole in the majority of the cases examined (93%). Third, prior imprisonment decreased the chance of prisoners to get parole. Fourth, prisoners who did not participate in treatment programmes in prison had lower chances for parole. Lack of treatment was also the most common reason for which committees declined parole applications. We argue that these findings reveal a gap between current efforts to decrease incarceration rates and develop alternatives to imprisonment and how parole is actually administered. Parole was found to be less accessible for returning prisoners and less appealing for prisoners with domestic abuse or sex offending background. At the same time, the state seems to support the approach that parole should be used scarcely. Moreover, while the committees place great emphasis on treatment in prison, formal data indicates that prison programmes are inaccessible to most prisoners and have limited success in decreasing recidivism. We argue that implementing the efforts to decrease incarceration requires the state and parole committees to acknowledge parole’s potential contribution to the public interest and rethink the balance between prisoners’ rehabilitation and public protection. We offer several steps for advancing this goal and encourage the continuing research and debate for increasing the use of parole in Israel.
