<b>תקציר בעברית: </b>המאמר מראה כי האיסור בחוק המחשבים התשנ"ה-1995 לחדור לחומר מחשב סובל מקשיים פורמליים ומהותיים ומבעיות בכל אפיק. החוק מנוסח בצורה לקויה, עמומה ורחבה מאוד; בית המשפט העליון שִכתב אותו לכיוון עמום ורחב אף יותר; ואולי חמור מכול – אין בבסיסו תכלית ברורה ועקיבה. איסור החדירה לחומר מחשב עמום מאוד בכל אחד מרבדיו ואי-אפשר למצוא היגיון שינסוך בו תוכן. גופו של האיסור (יסודות העבֵרה) רחב ועמום במיוחד, ולא ברור ממילותיו ומפרשנותו מה מוגן באמצעותו ומה לא. הבעיה חמורה יותר מאיסור עמום גרדא: לב האיסור (תכליתו) אינו מסייע להאיר על גופו משום שהוא עמום וחמקמק אפילו יותר. הערך המוגן – הסיבה שבגינה נולד האיסור ושבשמה הוא נאכף – אינו ברור ואינו אחיד, וספק רב אם יש הצדקה להגן עליו תחת הכותרת "חדירה לחומר מחשב", במסגרת חוק מיוחד המוקדש לטכנולוגיה אחת.<br><b>English Abstract: </b>The article shows that The Israeli Computer Law 1995 raises formal and substantial difficulties and problems from every aspect. The law is very vague and wide; The Supreme Court has rewritten it to make it even vaguer and wider - and there is no clear and coherent purpose behind it. This prohibition is deeply vague in each of its layers and one cannot suggest any consistency thereto. The formal definition of the prohibition is wide and vague and it is unclear from its language and its judicial interpretation what is protected by it and what is not. The problem is not merely a vague prohibition: the purpose of it does not assist us to understand the prohibition because it is even vaguer and more evasive. The values supposedly reflected by the prohibition, the reasons it exists – are unclear and incoherent. It is dubious whether it is justified to protect these values under a prohibition revolving around one specific technology, rather than under general laws that protect the same values.
