In recent decades, numerous public disputes concerning religion and state have taken on a legal character and been brought to the Supreme Court for resolution. The political institutions' foot-dragging and inability to formulate solutions in the political and social realm have led issues such as the drafting of yeshiva students, kashrut in the public sphere, conversion, and gender segregation to the doorstep of judicial review.
This article examines the Israeli Supreme Court's approach to these issues from a tripartite perspective: conceptual, empirical, and normative. On the conceptual level, we aim to gauge the court's role by integrating two distinct theoretical paradigms: judicial deference and inter-institutional dialogue. Do judges employ deference to avoid ruling on sensitive social issues or to limit their involvement? Do they attempt to create inter-institutional discourse to strategically prompt action in the political field? Contemplating these two meta-institutional questions gives rise to the concept of an "inter-relational space" between branches of government, proposing a shift from dichotomous thinking about inter-branch relations in activism or restraint terms towards a spatial conceptualization. This spatial thinking describes spheres of action (by the court) that, in turn, allow for spheres of response (by political authorities). The conceptual move undertaken in this article is the identification of various doctrines used by the court to adjudicate religion-state conflicts and their positioning within the inter-relational space according to their dialogic value and degree of deference.
Empirically, the article examines prominent rulings on state-religion issues over the past decade, mapping how the court has utilized these tools. The conclusion drawn from this mapping is that different judges employ – in rhetoric and practice – varying tools of deference to varying degrees concerning different religion-state issues, with no uniform line organizing the judicial modus operandi.
Normatively, the central argument is that in religion-state issues, which are polycentric in nature and raise exceptional social tension, the court should steer itself towards a more modest yet vital role in promoting democratic public regulation of religion-state issues. Within this framework, the court should consider judicious use of deference in appropriate cases where it can most effectively advance the pursuit of stable and sustainable solutions to the contentious value-based issue, as long as it meets the standards of proper and fair democratic process.
