The problem of judicial discretion is one of the main problems in modern jurisprudence. In what circumstances a judge may exercise discretion? Is he always allowed to exercise discretion or only when there is no clear answer in the law? In a case where there is no clear answer, is a judge free to exercise full discretion and create a new law or he is always bound by legal norms and therefore must apply them? The Hebrew term for judicial discretion – shikull ha-da'at - appears in both Talmuds bavli and yerushalmi. The Talmuds use this term in the context of a discussion about the responsibility of a judge for erroneous judgment. The sugiyot distinguish between cases where a judge erred when there was a biblical or rabbinic law and cases where there was no clear law and the decision was left for his own discretion. The article analyzes the various sugiyot and draws out of them different opinions regarding the circumstances in which a judge is allowed to exercise discretion and regarding the nature of his discretion, is it a creation of a new law or an application of existing norms.
