This article asks whether institutional investors, such as pension funds, are allowed to consider ethical considerations, and in particular, environmental considerations, when managing their investments. The idea that not only financial considerations should dictate investment decisions is not a novel one, but in recent years it has gained significant momentum due to the rapidly growing popularity of the term ESG (environmental, social & governance) investments. This trend has sparked intense legal and normative debates. From a legal perspective, institutional investors are considered trustees, since the assets they manage belong to others, the beneficiaries. Therefore, they are subject to a strict set of legal rules, including fiduciary duties. In their actions, institutional investors are obliged to act solely in the interests of their beneficiaries. It has been alleged that if the aims of the institutional investor when relying on ESG consideration are ethical, rather than that of well-defined and proven financial purposes, this would constitute a violation of fiduciary law. The article clarifies why this argument should not be accepted under Israeli law. Furthermore, it responds to various normative objections that have been raised against the call to include ESG considerations in the decision-making process of institutional investors and explains why they should be rejected, especially in regard to environmental considerationsThe article concludes by determining that when investing the public's money in the capital market, reference to environmental goals is not only compatible with the existing law but is also the sound and desired policy.
