בעקבות פסק דין בלורי: האם, וכיצד, יש לפטור חברות מתשלום אגרת בית משפט בהליכים אזרחיים (Exempting Corporations from Court Fees – Between Corporate Law and Civil Procedure)

<b>תקציר בעברית:</b>כל הליך משפטי דורש תשלום אגרה בטרם יחל בית המשפט במלאכתו, אלא אם כן חלים החריגים הקבועים בדין. ברם, חברות אינן נמנות עם בעלי הדין הפטורים מאגרה לפי תקנות בתי המשפט (אגרות), התשס"ז–2007. רשימה זו תתמקד בסוגיית מתן פטור מתשלום אגרת בתי משפט לחברות בהליכים אזרחיים. להלן תיבחן הסוגיה בכוונה להצביע על הפרשנות הראויה לתקנה 14 לתקנות האגרות במקרים שבהם חברות מבקשות פטור מאגרה מטעמי היעדר יכולת כלכלית, תוך התחשבות בעקרונות יסוד בדיני החברות. בהקשר זה יוצע, כי יכולתן הכלכלית של החברות תיעשה בהסתמך על הצגת המשאבים הזמינים לחברה ומכלול נכסיה; וכן את המשאבים אשר צדדים שלישיים בעלי זיקה ישירה לחברה, התומכים בה כלכלית, ואשר יש להם עניין כלכלי בהגשת התביעה, העמידו (או שלא העמידו) לרשותה לשם ניהול התובענה. <b>English Abstract:</b> In Israel, every legal procedure requires a payment of court fees. However, in certain situations the court can exempt an applicant this obligation. For individuals and state organs the exemption criteria are set in the Court Fees Regulations. But for corporation the Regulations do not provide guidelines. This paper analyzes the courts' interpretation of the Regulations and its application to corporation vis-à-vis fundamental principles of corporate law. It is suggested that in order to determine the corporation financial ability to pay court fees it is not only needed to examine the corporation’s resources, but also the financial incentives of third parties that support the corporation and have an interest in the suit.
