על המישפוט של תרבות האוכל הגלובאלית: היש למשפט הבינלאומי תפקיד בהגנה על ?מסורות קולינאריות ובקידומן (The Legalization of Global Food Culture: Can International Law Play a Role in the Protection and Promotion of Culinary Traditions?)

<b>תקציר בעברית: </b>בעשור האחרון מתחזקות מגמות במשפט הבינלאומי היוצאות להסדיר את המרחב התרבותי הגלובאלי בכללותו ואת התרבות של מסורות קולינאריות בפרט. מסגרות אלה כוללות את ההגנה המשפטית על ציונים גיאוגרפיים (Geographical Indications) של מוצרי מזון ומשקה, ההולכת ומתהדקת במסגרת הסכם הקניין הרוחני של ארגון הסחר העולמי (World Trade Organization - WTO), הסכמי סחר אזוריים ומערכת ליסבון להגנה על כינויי מקור (Appellations of Origin) במסגרת ארגון הקניין הרוחני העולמי (World Intellectual Property Organization - WIPO); את אמנת ארגון האומות המאוחדות לנושאי חינוך, מדע ותרבות (UNESCO - אונסק"ו) בדבר ההגנה על מגוון ביטויי התרבות וקידומו (Convention on the Protection and Promotion of the Diversity of Cultural Expressions ), משנת 2005 (CCD); את אמנת אונסק"ו בדבר שימור מורשת התרבות הבלתי מוחשית (Convention on the Safeguarding of Intangible Cultural Heritage) משנת 2003 (CSICH); ואת טיוטת WIPO לאמנה בינלאומית בנושא ידע מסורתי (Traditional Knowledge) משנת 2014. מגמות אלה מעוררות שאלות עקרוניות וכבדות משקל. האם כלל ראוי שהמשפט הבינלאומי יתערב בעיצוב תרבויות של אוכל? מהי ההצדקה להתערבות כזו והאם היא יכולה להיות אפקטיבית במיצויה? למשל, האם מסורות "הארוחה הגסטרונומית הצרפתית" או "תרבות הקפה של בואנוס איירס" זקוקות להגנה משפטית וכלל יכולות ליהנות ממנה? האם יש להגנה המשפטית על המונח "קיאנטי" (Chianti) ככינוי לסוג יין ממחוז גיאוגרפי מסוים בצפון איטליה הצדקה תרבותית דווקא? ומהן התוצאות בפועל של התערבות משפטים כזו על התפתחותן של תרבויות מזון ומשקה? במאמר זה אטען שכלים משפטיים בינלאומיים אלו לוקים בחוסר קוהרנטיות ואפקטיביות, כאשר קיימים ספקות משמעותיים לגבי הלגיטימיות של עצם השימוש בהסדרים משפטיים להסדרה של מסורות קולינאריות.</p> <b>English Abstract:</b>This article, written for an edited book on law and food (the first of its kind in the Hebrew language), discusses trends that have evolved over the last decade or so, involving international attempts to regulate the global cultural space in general, and culinary traditions in particular, through legal means. These efforts include increased regulation of Geographical Indications (GIs) and Appellations of Origin, focusing on food and drink products, in the WTO, WIPO and regional arrangements; respective UNESCO conventions on the Protection and Promotion of the Diversity of Cultural Expressions (CCD), and Intangible Cultural Heritage (ICH); and the ongoing Traditional Knowledge (TK) debate in WIPO. The article focuses on the first two, asking whether law should intervene in the development of food culture, and whether such intervention can be effective. Typically, these forms of legalization are claimed to be justified through the concept of the protection and promotion of culture and the diversity of cultural expressions. In this article, through an examination of the relevant international legal instruments as well as short case studies (in particular the Chianti Classico GI, and the UNESCO element of ICH, the "Mediterranean Diet", I argue that there exists significant doubts regarding the legitimacy and effectiveness of such forms of legalized (and ultimately politicized) intervention in the development of food culture and culinary traditions.</p>
