Hozei Rashut Beisrael (Government Contracts in Israel)

The question, which legal regime and forum in Israel should govern contracts entered into by administrative bodies, has been the subject of considerable debate in recent years. This debate originated in Israel in 1979 with the publication of an article in the Israel Law Review ("Administrative Contracts" (1979) 14 Is. L.R. 444) by Prof. Gabriela Shalev of the Faculty of Law at The Hebrew University of Jerusalem, calling for the application of a synthesis of contract law and public law. Prof. Shalev has recently published a book, under review here, in which she further developed and elaborated on her thesis. Two reviews of this book were submitted to the Israel Law Review, each reflecting a different approach to the subject of administrative contracts - for while both reviewers are of the "continental" school, the one (Dr. Renee Sanilevici) specializes in private law and the other (Prof. Claude Klein) in public law. In view of the importance of the subject-matter, we have decided to present both reviews; we trust our readers will find the discussion of interest.
