Les Relations Entre La Republique Federale D’Allemagne Et L’Etat D’Israel (Relations between the Federal Republic of Germany and the State of Israel)

<b>French Abstract:</b> La crise, parfois tragi-comique, que l’on a appelée "la crise des 28 jours" qui a mis aux prises, au début de 1965, la République fédérale d’Allemagne d’une part, la République Arabe Unie et PEtat d’Israël d’autre part, a remis au premier plan de l’actualité un des problèmes les plus douloureux de l’aprèsguerre, celui des relations de l’Allemagne avec le peuple juif. Sur le plan du droit international, ce problème s’est cristallisé autour des relations entre l’Allemagne fédérale et l’Etat d’Israël. Dans la mesure même où la République fédérale d’Allemagne se reconnaissait comme continuatrice de PEtat allemand d ’avant la guerre et entendait, en conséquence, assumer l’hypothèque que représente l’effroyable passé allemand, et dans la mesure où PEtat d’Israël s’est construit en partie sur les ruines du judaïsme décimé, ces relations ne pouvaient que se trouver gravement affectées et devaient fatalement échapper aux cadres des relations interétatiques. A ces raisons, qui frisent l’éthique même, devaient s’en ajouter d’autres plus politiques, tenant à la nature particulière de ces deux Etats que sont la République fédérale d’Allemagne et PEtat d’Israël: Etats contestés, Etats divisés, se retrouvant par là même dans des situations assez semblables. Tout concorde donc pour faire des relations entre la R.F.A. et l’Etat d’Israël des relations particulières. Ces particularités nous les retrouverons à tous les niveaux de l’analyse. Que ce soit au niveau même des relations d’Etat souverain à Etat souverain, c’est-à-dire au niveau du droit international le plus général, ou au niveau des relations entre l’Etat qui se reconnaît comme lié juridiquement à l’Etat qui a massacré 6 millions de personnes et l’Etat qui se reconnaît une vocation particulière face à ces victimes, nous trouverons partout des particularités. Ces deux niveaux de l’analyse vont nous permettre de regrouper l’étude en deux étapes: d’une part, les rapports spéciaux dans le cadre du droit international général, d’autre part, les rapports spéciaux, exorbitant du droit international. <b>English Abstract:</b> The crisis, at times tragicomic, which has been called "the crisis of 28 days" which pitted at the beginning of 1965, the Federal Republic of Germany on the one hand, the United Arab Republic and the State of the other Israel, gave the first news the plan one of the most painful problems of the post-war, the relations between Germany and the Jewish people.
