English Abstract:At first glance it would seem that Israeli criminal law has not been greatly revolutionized over the past 3 years. With the exception of a new statutory sentencing reform, no major changes in the criminal justice system can be detected by simply looking at the legislation or Supreme Court rulings. Yet, major changes have occurred behind the scenes through decisions by key players in the criminal justice system. This article explores some of these developments, starting with the effects of a new statistical-measurement program of the Israel Police, called “mifne” (Hebrew for “shift”). This in-house program measures the performance of police units based on, among other things, the number of cases the court denied bail from defendants and remanded defendants. As a result, the adoption of the program led to a steep rise in the number of detainees in criminal cases. In contrast, sentences have not changed dramatically despite a legislated sentencing reform. The technical and formal components of the reform were indeed adopted by the courts, but the more substantive characteristics of that reform remain largely unimplemented. Finally, the article describes some of the emerging alternatives to criminal trials. On the one hand, two substantial reforms were introduced without legislation: the establishment of the first Community Court, and the reliance on guidelines for the diversion of cases from prosecution. On the other hand, a legislation-based reform for conditional dismissal of cases, encountered strong police opposition and was implemented very slowly. Reviewing the above trends, the article reveals the limited power of the legislature to impact on the criminal process when compared with the substantial powers of key players in the criminal justice system, such as the Prosecution and the Israel Police. In conclusion, the article discusses the future implications of the reviewed trends.
