לימודי משפטים כתמריץ לשינוי חברתי מגזרי וחוץ-מגזרי: המקרה של סטודנטים ערבים למשפטים במכללת צפת

תקציר בעברית:בית הספר למשפטים במכללה האקדמית צפת, כמוסד ציבורי לחינוך משפטי בפריפריה הגיאוגרפית והדמוגרפית, מזמן זירה מרתקת לניתוח ההבדלים בתפיסות העולם בין אוכלוסיית הסטודנטים היהודית לאוכלוסיית הסטודנטים בני המיעוטים. מחקר זה, כממשיך דרכם של מחקרים נוספים הבוחנים את השפעת לימודי המשפטים על עיצוב תפיסת עולמם של משפטני העתיד, מציג תמונה מורכבת. מחד, התלמידים מגלים במהלך לימודיהם את כוחו של המשפט לחולל שינויים חברתיים. עבור סטודנטים המגיעים מאוכלוסיות מוחלשות יוצר הגילוי תמריץ לשמש כסוכני שינוי בקהילות המוצא שלהם. מאידך, מתעורר אצלם במהלך לימודיהם תסכול רב הנובע מהפער בין הבנתם החדשה ביחס לצרכים החברתיים לבין הכלים המוענקים להם לשם כך במסגרת החינוך המשפטי. עוד עולה ממחקר זה כי תכנית הלימוד בבית הספר למשפטים, כמו גם האינטראקציות בין התלמידים לבין עצמם, מהווים גורם משפיע על תפיסותיהם הערכיות, ביחס לחברת המוצא שלהם, כלל החברה הישראלית והמשפט עצמו. המחקר - איכותני במתודולוגיה ומבוסס על שאלונים - חושף את תפיסות העולם של הסטודנטים הערבים בנוגע לשאלות אלו, על רקע מוצאם המגזרי.English Abstract:Zefat College School of Law, as a public institute in the social and geographical periphery of Israel, constitutes a fascinating field for examination of the differences in attitudes between Arabs and Jews. This research, following in the footsteps of previous studies on the effects of legal education on the moral attitudes of future lawyers, presents a complex reality. On one hand, the students discover the power of law in promoting social change. For those coming from oppressed minorities, this breakthrough creates an incentive to act as agents of change in their communities. On the other hand, throughout the course of their studies they encounter frustration due to the gap between their new understanding and the tools that law school equips them with in order to carry the changes through. Furthermore, this study shows that the curriculum, as well as interactions amongst the students themselves, has an effect on the formation of moral and social attitudes of the students, regarding their communities, society in general, and the law. This paper, based on a qualitative research methodology, exposes the moral and social attitudes of Arab students, in light of their ethnic origin and social status in Israel.
